Terms & Conditions

1. Eligibility

• The Renter must be at least 21 years old.
• The Renter must hold a valid and original motorcycle or scooter driving license recognized in the Kingdom of Morocco for the rented vehicle (mandatory for vehicles over 50cc).
• The Renter confirms having sufficient riding experience.
• Waves & Wheels reserves the right to assess the Renter's riding ability and refuse the rental if the Renter is deemed unfit or unsafe.
• Waves & Wheels reserves the right to refuse rental at its discretion without obligation to provide justification.

2. Required Documents & Data Use

• A valid original driving license
• A valid passport or national identity card
• A refundable security deposit (cash or other agreed payment method)
• Copies or photographs of documents may be retained solely for legal, insurance, or regulatory purposes and handled in accordance with applicable Moroccan data protection principles.

3. Rental Period

• The rental period starts and ends at the exact date and time specified in the rental agreement.
• Late returns may result in additional charges calculated hourly or daily, in accordance with the price list displayed or agreed in writing.
• No refunds are granted for early returns.

4. Vehicle Condition & Inspection

• The Vehicle is delivered in clean, roadworthy, and good working condition.
• The Renter confirms having inspected the Vehicle prior to departure.
• Any existing damage must be reported before leaving the premises and recorded in the vehicle condition report.
• Failure to report damage before departure constitutes acceptance of the Vehicle as damage-free.

5. Proper Use of the Vehicle

• To operate the Vehicle responsibly and in full compliance with Moroccan traffic laws.
• To use the Vehicle only on paved, public asphalt roads.
• Off-road riding, sand, beaches, trails, gravel, dirt roads, mountains, or any non-asphalt surface is strictly prohibited.
• Racing, stunts, or reckless riding is strictly prohibited.
• Commercial use or illegal activities are strictly prohibited.
• Not to allow any other person to operate the Vehicle.
• To wear a helmet at all times. Helmets are provided and their use is mandatory.
• Any unauthorized or prohibited use renders the Renter fully liable for all resulting damages and voids any applicable insurance coverage.

6. Accidents, Damage & Theft

• In the event of accident, damage, breakdown, or theft, the Renter must notify Waves & Wheels immediately.
• The Renter is fully financially responsible for any damage to the Vehicle, loss or theft of the Vehicle, and damage caused by falls, misuse, negligence, or prohibited use.
• Repair costs, towing, administrative fees, and loss of rental income may be charged and deducted from the security deposit.
• In the event of theft or total loss, the Renter is liable for the market value of the Vehicle at the time of loss.

7. Insurance

• The rental includes only mandatory third-party liability insurance, as required by Moroccan law, if explicitly stated in the rental agreement.
• This insurance does not cover: damage to the rented Vehicle, theft or total loss, personal injuries or medical expenses, or personal belongings.
• Insurance coverage is void in cases of: reckless or negligent riding, off-road or prohibited use, alcohol or drug use, traffic violations, or unauthorized riders.
• The Renter remains fully responsible for all fines, penalties, damages, and legal consequences arising during the rental period.

8. Traffic Violations & Fines

• All traffic fines, parking tickets, penalties, or violations incurred during the rental period are the sole responsibility of the Renter.
• Fines received after the rental period that relate to the Renter's use of the Vehicle will be charged accordingly.
• An administrative processing fee may apply.

9. Fuel Policy

The Vehicle must be returned with the same fuel level as at the start of the rental. Missing fuel will be charged at the current market price, plus a service fee.

10. Cancellations & No-Shows

• Cancellations made less than 24 hours before the rental start time may be charged up to 100% of the rental amount.
• No-shows may be charged the full rental amount.
• Weather conditions, including wind, rain, or poor sea conditions, do not justify refunds.

11. Security Deposit

• The security deposit serves as a guarantee against damages, loss, fines, late returns, or missing items.
• The deposit will be returned within 24 to 72 hours after the Vehicle is inspected and confirmed to be in acceptable condition.
• Waves & Wheels may retain part or all of the deposit to cover applicable charges.

12. Liability Disclaimer

To the fullest extent permitted by Moroccan law, Waves & Wheels shall not be held liable for accidents, injuries, death, or damages suffered by the Renter or third parties during the rental period. The Renter assumes full responsibility for the Vehicle and its use throughout the rental period.

13. Termination of Rental

Waves & Wheels reserves the right to terminate the rental immediately and without refund in the event of breach of these Terms & Conditions, including but not limited to misuse, prohibited riding, or false documentation.

14. Governing Law & Jurisdiction

These Terms & Conditions are governed by the laws of the Kingdom of Morocco. Any dispute shall fall under the exclusive jurisdiction of the competent Moroccan courts.

15. Acceptance

By signing the rental agreement or taking possession of the Vehicle, the Renter confirms acceptance of these Terms & Conditions.
